General Terms and Conditions of Business

By placing your order you acknowledge the following General Terms and Conditions of Business.

1. General Provisions

The following General Terms and Conditions of Business shall apply for all contracts concluded with GOLFINO AG (hereinafter “GOLFINO”) on the purchase and delivery of goods from the GOLFINO online shop. We hereby expressly object to differing provisions of the contractual partner. All side agreements must be confirmed in writing by GOLFINO in order to be valid.

2. The right to exchange and return free of charge

You can send all articles purchased at the GOLFINO online shop without giving a reason within 14 days after receipt free of charge with the enclosed return sticker, with the exception of perfume/cosmetics no longer in their original packaging. The sales contract will not come into force until the expiry of the 14-day return period. The goods can only be exchanged within the GOLFINO online shop and not in the GOLFINO stores/shops.

Please note that, in this case, the delivered goods must only have been used for the purpose of testing, as would be usual to try on the item in a retail store, for instance, and must be returned with the original label. In the event the goods have been damaged, compensation can be requested. We shall repay the full sales price to the credit card account used to make the purchase. Exchange is only possible when a new order is made.

In the event that material or manufacturing faults are found in the delivered articles, please inform us of these faults immediately. The failure to make such notice of faults shall however have no effect on your statutory claims.

3. Order and refusal of order

GOLFINO reserves the right not to accept online orders (e.g. if an article is not available or if invoices previously issued to you remain unpaid without good reason). This decision shall be at GOLFINO’s discretion. Sending of the goods constitutes acceptance of the customer's offer. If an online order will not be carried out, GOLFINO shall inform you of this as soon as possible. Only orders in normal household quantities shall be accepted.

4. Prices

The current prices given at any time shall apply. All prices include German sales tax at the current rate established by law, but not shipping costs.

5. Delivery and shipping costs

In general, the delivery time shall be from 1 to 5 working days from placement of the order. Shipping costs shall amount to 6 euros within Germany and 10 euros for other European countries (with the exception of Madeira, the Canary Islands and the Balearic Islands) per order.

The recipient of international deliveries can be subject to import duties and taxes that will be charged as soon as the delivery has reached the country of destination. Additional costs for customs clearance shall be borne by the recipient. GOLFINO has no influence on these charges and is not able to provide information on their amount. Customs regulations vary greatly from country to country. Please contact your local customs authorities for further information.

6. Payment

GOLFINO only offers the possibility of paying by credit card.

If you decide to pay with a current credit card, GOLFINO reserves the right to check the validity of the credit card, creditworthiness in relation to the order amount and whether the purchaser's address is correct and shall be entitled to refuse orders on the basis of the findings of these checks.

7. Reservation of proprietary rights

The goods shall remain the property of GOLFINO AG until full payment.

8. Statutory cancellation instructions

Right of return. You can return the received goods without giving reasons by sending back the goods within two weeks. This period begins, at the earliest, on receipt of the goods and of these instructions. In order to meet the cancellation period, it is sufficient to send the goods in good time. In any event, the return shall be made at our cost and risk. The return is to be made using the enclosed return sticker to:

Consequences of return

In the event of an effective return, both sides shall be reimbursed for performances received and any use taken (e.g. benefits gained from use) shall be compensated. In the event the goods have been damaged, compensation can be requested. This shall not apply if the damage to the goods can exclusively be attributed to the examination of them, as would have been possible for you in the retail shop, for instance. Furthermore, you can avoid the obligation to pay compensation by not using the goods as an owner and refraining from anything that could affect their value. Obligations to reimbursement payments shall be met within 30 days. The period shall begin for you on the sending of the goods or the return request and for us on receipt.

9. Data protection & creditor protection

Of course, all personal data shall be fundamentally treated as confidential and your interests requiring protection will be strictly taken into account in accordance with statutory provisions.

In addition to the purposes given above, we shall also use your data for marketing purposes, in particular for the purpose of advertising GOLFINO products. You can object to the processing or sending and other use of your data for marketing purposes or revoke your consent at any time by notifying GOLFINO (clubmember-service@golfino.com). After receipt of your objection or revocation, we shall no longer use or process the data in question for marketing purposes and shall immediately stop sending advertising material.

10. Exclusion of liability for third-party links

Insofar as the GOLFINO Internet sites include links to other Internet sites, GOLFINO expressly declares that it has no influence on the design and content of the linked sites. GOLFINO therefore expressly distances itself from all contents of all linked third-party sites. This declaration applies for all displayed links and for all contents of the sites to which links lead.

11. Warranty

Unless expressly otherwise agreed, the statutory warranty provisions shall apply.

12. Copyright

The website is the property of GOLFINO AG. The entire content of the website, including texts, graphics, photos, images, illustrations and sounds is the property of GOLFINO AG. All elements of the website are protected by copyright and other rights. Unless otherwise specified, all trade marks, service marks and trade names are trade marks or registered trade marks/brands of GOLFINO. Use without prior written consent from GOLFINO is not permitted and may lead to criminal prosecution.

13. Miscellaneous

German law shall apply, to the exclusion of UN law on sales, to all contracts and agreements between the customer and GOLFINO.
